Can the IRS Take My Truck?
It's the first thing most owner-operators ask, and the honest answer is that it can, but the law makes it hard. Federal law protects property used in your own trade or business from levy unless a senior IRS official approves the seizure in writing, or the IRS finds that collection is in jeopardy. That's in Section 6334 of the Internal Revenue Code.
What protects the truck in practice is that approval requirement, and the fact that the IRS usually has easier money to reach first: your broker payments and your bank account. So the time to deal with it is before the Final Notice of Intent to Levy runs out, not after.

When the IRS Levies Your Broker or Factoring Company
The IRS uses Form 668-A to levy property a third party is holding, and that includes business receivables (IRS, third-party levies). For a trucker, that's the money a broker or factoring company owes you for loads you've already hauled.
Once the broker gets that notice, it has to turn the money over to the IRS instead of paying you. Your settlements stop, fuel still has to be bought, and the truck payment is still due.
