IRS Tax Relief in New York Back Taxes Help for Bonuses, Payroll, and 1099s.
Updated
In New York, a lot of IRS debt starts with income the paycheck didn't fully cover: a year-end bonus withheld at a flat rate, freelance and rideshare 1099s, a small business that fell behind on payroll deposits. Our Enrolled Agents, CPAs, and tax attorneys represent New Yorkers before the IRS by phone, secure portal, and video, from the first notice to the program that resolves it.

IRS Problems New Yorkers Bring Us
New York pays big Wall Street bonuses and runs on freelancers, subcontractors, drivers, and small shops. Each of those can leave a gap between what was withheld and what the IRS says you owe. These are the cases we see most from around the state.
Bonuses Withheld at the Flat 22% Rate
Wall Street's average bonus for 2025 was $246,900, Reuters reported. Employers can withhold federal tax on bonuses at a flat 22% up to $1 million, even when your bracket is 35% or 37%. When that shortfall comes due in April, we set up an IRS payment plan that fits your cash flow.
Learn moreFreelance and 1099 Income With No Withholding
Designers, writers, photographers, consultants, and musicians get paid on 1099s with nothing taken out. Quarterly estimates slide when invoices pay late, and a year or two of that turns into back taxes, penalties, and sometimes unfiled returns. We file what's missing and find the IRS program that fits.
Learn morePayroll Tax Debt for Restaurants and Small Shops
Restaurants, bodegas, salons, and shops fall behind on 941 deposits when cash gets tight. The IRS treats withheld payroll taxes as trust fund money, and it can assess owners personally through the trust fund recovery penalty, even while the business is still open. We take over IRS contact and work the quarters back into order.
Learn moreConstruction Trades and Subcontractors
Subs get paid on 1099s, then carry payroll for their own crews between draws. Miss enough deposits and the IRS can levy money a general contractor owes you or freeze the business account. We file Power of Attorney, request a release backed by a plan, and sort out the open quarters.
Learn moreRideshare and Delivery Drivers
Driving for the apps pays with no withholding, and the 1099s show gross fares, not what you kept after gas, tolls, and insurance. Skip a filing year and the IRS can file a substitute return that may not credit those costs. We file the real return first, then work out what's actually owed.
Learn moreHurricane Ida Relief and Old Balances
After Hurricane Ida in September 2021, the IRS moved many deadlines to Feb. 15, 2022 for 14 counties, including all five boroughs, Westchester, Nassau and Suffolk. Payments on 2020 returns, due May 17, 2021, weren't covered. If penalties from those years are still on your account, we check the dates and request abatement where the rules allow it.

Tax Resolution Services Across New York
From a studio in Manhattan to a farmhouse in Chautauqua County, the IRS plugs different numbers into a New Yorker's case depending on the county. If you owe the IRS money, these are the programs we use to settle IRS debt or bring it down to something you can manage, with the local figures that shape each one.
IRS payment plans
Installment Agreements and IRS Payment Plans Across New York
$6,003 vs. $1,867
IRS 2026 monthly housing allowance for a family of four: New York County vs. Chautauqua County.
For New Yorkers, a monthly installment agreement is the usual way out of an IRS balance. At $50,000 or less, a streamlined plan usually doesn't require a full financial statement. Above that, Form 433-A comes into play, and the county you live in changes the answer a great deal.
The IRS's 2026 housing and utilities allowance for a family of four is $6,003 a month in New York County, $5,168 in Westchester County and $4,631 in Kings County. Upstate, it's $2,433 in Monroe County, $2,366 in Erie County and $1,867 in Chautauqua County, the lowest in New York.
Same income, very different payment. An enrolled agent on our team builds your 433-A with the allowance for your county and your actual bills, so the plan fits the place you really live.
Fresh Start
How the IRS Fresh Start Program Applies in New York
$50,000
The streamlined-plan ceiling that covers many New York bonus and 1099 balances.
Fresh Start was a 2011 overhaul of IRS collection policy, not a special application. It raised the lien filing threshold to $10,000, opened streamlined installment agreements to balances up to $50,000, and gave people more room to qualify for an Offer in Compromise.
In New York, where so many balances come from a bonus withheld at a flat 22% or a year of 1099 work, that $50,000 streamlined line covers a lot of cases. Be wary of any company that sells Fresh Start as debt forgiveness. The IRS still reviews income, expenses and filing history before it agrees to anything.
- Lien filing threshold: $10,000
- $50,000 cap on streamlined installment agreements
- Less rigid Offer in Compromise standards
Wage garnishment
What to Do About an IRS Wage Garnishment in New York
$619.23 every two weeks
Exempt from an IRS wage levy in 2026 for a single filer with no dependents, anywhere in New York (Publication 1494).
An IRS wage garnishment comes at the end of a paper trail: a CP504, then a final notice on LT11 or Letter 1058 with 30 days to ask for a Collection Due Process hearing. If nothing happens in that window, your employer gets a levy and holds back pay every period until the IRS releases it.
What you keep comes from Publication 1494, and it's the same in Manhattan as in Jamestown. In 2026, a single filer with no dependents paid every two weeks keeps $619.23 a check. With downstate rents, that rarely covers housing, which is why we pair the release request with a payment plan or hardship status.
Offer in Compromise
Offer in Compromise Eligibility in New York
$417 vs. $330
IRS 2026 monthly operating allowance for one car: New York City metro area vs. the rest of New York.
An Offer in Compromise asks the IRS to accept less than you owe because it can't collect the full balance before the collection statute expiration date. The filing includes Form 656, Form 433-A (OIC), a $205 fee and, for a lump-sum offer, an initial 20%.
The math leans on local standards. Running one car is allowed at $417 a month in the New York City metro area and $330 in the rest of New York, on top of the county housing figures. Higher allowances downstate can lower what the IRS thinks it could collect, so we run the numbers for your county before anything is filed.
Liens and levies
IRS Tax Lien and Levy Help Across New York
21 days
Days a levied New York bank account stays frozen before the money is sent to the IRS.
Liens and levies hurt in different ways. The lien is a public notice that clouds a co-op sale, a refinance or a business loan. A levy takes money outright, from a bank account, from wages, or from what a client or general contractor owes your business.
A levied bank account is frozen for 21 days before the bank sends the money, and that's when a bank levy release request matters most. For liens, the options are a discharge when you sell, a subordination when a lender needs to go first, and a withdrawal once a qualifying direct debit plan is running.
Back taxes
Back Taxes and Unfiled Returns in New York
$246,900
Average Wall Street bonus for 2025 (Reuters), often withheld at a flat 22%.
Back taxes in New York often start with pay that was withheld at the wrong rate. Wall Street's average bonus for 2025 was $246,900, and a bonus can be withheld at a flat 22% even when the rest of your pay puts you in the 35% bracket. Freelancers, rideshare drivers and construction subs on 1099s start with nothing withheld at all.
Restaurants, bodegas and salons that fall behind on 941 deposits build payroll tax debt the IRS can assess against owners personally. If returns are missing, we file them before anything else and replace any substitute return the IRS prepared, so the balance reflects your real deductions.
Currently Not Collectible
Currently Not Collectible Status for New York Households
$4,350 a month
One person living in Manhattan (New York County): the IRS's 2026 monthly housing and utilities figure.
If paying the IRS anything would leave you short on rent, the IRS can mark your account currently not collectible. Collection stops, levies included. Interest still accrues, though, the IRS may file a lien anyway, and your finances get another look down the road.
In Manhattan, the IRS counts $4,350 a month for one person's housing and utilities, while in Erie County it counts $1,715. The same salary can mean hardship in one county and a payment plan in another. We document your actual costs on Form 433-A so the IRS sees the full picture.
Penalty abatement
IRS Penalty Abatement in New York After Ida and Other Storms
Feb. 15, 2022
The IRS deadline for 14 New York counties after the remnants of Hurricane Ida.
If you qualify for first-time relief or have reasonable cause, penalty abatement can clear failure-to-file and failure-to-pay penalties from your IRS account. Starting with 2025 returns, the IRS is also applying an automatic exemption when you filed and paid on time for the three prior years. Older years still need a request.
Disaster relief reaches across New York. After the remnants of Hurricane Ida in September 2021, the IRS moved deadlines to February 15, 2022, in 14 counties, including all five boroughs and Westchester, Nassau and Suffolk counties. Western counties had storm deadlines in 2023, and Suffolk County's August 2024 storms pushed deadlines to February 3, 2025.
If a late penalty was charged for a date one of those postponements covered, it may not belong on your account. We compare your transcripts to the relief dates and ask the IRS to take it off.
- Remnants of Hurricane Ida, 14 counties: Feb. 15, 2022
- Western New York snowstorms: March 15 and May 15, 2023
- Suffolk County storms: Feb. 3, 2025
- Saint Regis Mohawk Tribe flooding: Feb. 3, 2025
