What an IRS Debt Looks Like for a Long Island Contractor
A contractor on Long Island usually owes the IRS in one of two ways. Either it's income tax on 1099 work with no estimated payments, or it's payroll tax from quarters where the 941 deposit lost out to a supplier or a truck payment. The second kind is more serious.
Withheld payroll taxes are held in trust for the IRS. If they aren't paid over, the IRS can assess the trust fund recovery penalty against whoever controlled the money, and that follows you personally even if the company closes.
Collection also looks different for a contractor. Besides bank accounts, the IRS can levy money a general contractor or homeowner owes you, which can stall a job halfway through. Getting current on filings first gives us room to ask for a payment plan and a release.

A W-2 Paycheck, a Side Business and a Bill in April
This one catches careful people on Long Island. The day job withholds correctly, so the return feels like it should come out even. Then the side business adds profit with no withholding at all, plus 15.3% self-employment tax for Social Security and Medicare. A few thousand dollars of profit can turn a refund into a balance.
The fix going forward is simple: raise the withholding on your W-4 or send quarterly estimates. If your adjusted gross income was over $150,000 last year, paying 110% of last year's tax through withholding and estimates generally keeps the underpayment penalty away.
For the years you already owe, we check whether penalties can be removed, then set up a payment plan that fits next to the mortgage and the commute.

There's no separate Fresh Start form to file.
The lien piece matters on Long Island, where so much of a family's net worth sits in the house. Keeping a balance under that line, or getting it onto a plan early, can keep a federal tax lien out of the county records. Anyone who says Fresh Start forgives debt by itself is wrong. The IRS reviews every request.

Miss that window and the levy goes to your employer, who holds back everything above the Publication 1494 exempt amount each pay period. Because the IRS generally can't keep levying once an installment agreement is in effect, we usually start by getting returns current and a plan or hardship request in front of the IRS, then ask for the release.

That weighing counts equity, which is where an offer on Long Island can run into trouble. A mostly paid-off house in Nassau or Suffolk often has enough equity to cover the debt on paper, even when the monthly budget is tight. A federal tax lien is the IRS's public claim against your property, recorded in county records. On Long Island it tends to surface at the worst moment: a house sale, a refinance, or a business line of credit. A levy is different. It actually takes money, from a bank account, a paycheck, or a payment a general contractor owes you.
When a bank account is levied, the bank holds the money for 21 days before sending it, and that's when we push for a bank levy release. For a house sale, we can apply for a lien discharge so the closing goes through. For a refinance, there's subordination. After a direct debit plan on $25,000 or less, there's withdrawal.

When that happens, the IRS can put the account in currently not collectible status. Levies stop, but interest keeps accruing, a lien can still be filed, and the IRS reviews your finances again down the road.
The test is your Form 433-A against IRS allowances. For one person, the 2026 housing and utilities figure is $3,571 a month in Nassau County and $3,167 in Suffolk County, and car operating costs in the New York metro are allowed at $417 a month. Documenting every real expense is what carries a hardship case.

Suffolk County has had two recent IRS disaster postponements: deadlines moved to May 15, 2023 after the December 2022 winter storm, and to February 3, 2025 after the storms and flooding that began August 18, 2024. Nassau and Suffolk were both covered after Sandy and Ida. A penalty charged inside one of those windows is worth challenging.
Outside disasters, penalty abatement comes through reasonable cause, like a serious illness, or first-time relief. Starting with 2025 returns, the IRS is replacing First Time Abate with an automatic exemption for people with three years of timely filing and payment. Older years on Long Island still need a written request, which we prepare.
