The IRS still treats the state as many local markets, with different allowances in Collin County than in Hidalgo County. An installment agreement is the most common way Texans resolve an IRS balance. At $50,000 or less, a streamlined plan generally avoids a full financial disclosure. Above that, Form 433-A compares your budget with county allowances, and in Texas those vary by more than $1,600 a month.

For a family of four in 2026, the IRS allows $3,836 a month for housing and utilities in Collin County, the highest in the state, and $3,564 in Travis County. Dallas County sits at $3,034 and Harris County at $2,971. In Bexar County it's $2,728, in El Paso County $2,350, and in Hidalgo County $2,214.

Back in 2011, the IRS rolled out a group of collection changes under the Fresh Start name. Federal tax liens became generally reserved for balances over $10,000, streamlined installment agreements expanded to $50,000, and the Offer in Compromise formula started counting more of what families really spend.

Across Texas, those rules mean a lot of balances can be handled without a lien in the county records or a deep financial review. They don't mean the IRS forgives debt on request. If a company on TV promises Fresh Start forgiveness before looking at your transcripts, keep looking.

How to Stop an IRS Wage Garnishment in Texas

From an LT11 or Letter 1058 to request a Collection Due Process hearing.

Texas law shields paychecks from most creditors, which surprises people when the IRS garnishes anyway. A federal levy isn't bound by that protection. The sequence is a CP504 notice, then the LT11 or Letter 1058, which gives you 30 days to request a Collection Due Process hearing before the levy reaches payroll.

From there, the levy takes everything above the Publication 1494 exempt amount, every payday, from a refinery check in Beaumont to a hospital check in El Paso. It continues until released. A payment plan, hardship status or other resolution is generally what gets the IRS to lift it.

Offer in Compromise

An Offer in Compromise asks the IRS to settle IRS debt for less than the balance when you can't pay it in full before the collection statute expiration date. You submit Form 656, Form 433-A (OIC), the $205 application fee and, on a lump-sum offer, 20% of the amount offered.

Where you live in Texas changes the math. A household in Collin County gets $1,622 a month more in housing allowance than the same household in Hidalgo County, which lowers what the IRS expects it can pay. Texas homestead protections are strong against ordinary creditors, but a federal tax lien can still attach to a Texas home and show up at closing. The IRS can't levy your main home without a federal judge's approval, so for most people the lien is the property problem and the levy is the cash problem.

Levies hit checking accounts, wages, and payments owed to contractors and owner-operators. A levied bank account is held for 21 days, which is the window for a bank levy release. For a lien, we can request a discharge to sell, subordination to refinance, or withdrawal after you set up a direct debit plan that qualifies.

A lot of Texas income arrives with nothing withheld. Oil field contracts in the Permian Basin, roofing and framing crews after storm season, freight hauled up I-35, and app-based driving in every metro all pay on a 1099. That income carries 15.3% self-employment tax on top of income tax, and back taxes build fast without quarterly estimates.

Employers have their own version: 941 payroll tax deposits that slip when cash gets tight. If returns went unfiled, the IRS may have filed substitute returns without your expenses. We file accurate returns for the missing years first, because no IRS program moves forward while a required return is still outstanding.

When your basic living costs take everything you earn, the IRS can place the account in currently not collectible status. Levies and collection activity stop. Interest keeps accruing, the IRS can still file a lien, and it checks your income again later.

Whether you qualify depends partly on where in Texas you live. The IRS allows $361 a month to run one car in the Houston metro and $339 in Dallas-Ft. Worth, while the rest of the state, from Austin to Laredo, uses the South region figure of $291. Housing allowances vary even more from county to county.

Every county in Texas got IRS deadline relief to June 15, 2021, after Winter Storm Uri.

Penalty abatement can remove failure-to-file and failure-to-pay penalties. First-time relief applies if your prior three years were clean. Reasonable cause covers things outside your control, and in Texas that often means a disaster.

Winter Storm Uri covered all 254 Texas counties, with deadlines moved to June 15, 2021. Since then, Hurricane Beryl pushed deadlines to February 3, 2025 for 67 counties including Harris and Nueces. The April 2024 storms moved them to November 1, 2024 for Collin and Dallas counties, among others, and the July 2025 floods to February 2, 2026 for Kerr and Travis counties.

Does Texas Have a State Income Tax?

No. Texas does not tax personal income, so for most Texans the tax debt we work on is owed to the IRS. That keeps a case focused on one set of IRS records and one set of IRS resolution programs.

Can the IRS Garnish My Wages in Texas?
