Tax appeal help
IRS Tax Appeal Services
Updated
If you disagree with an IRS adjustment, you have a legal right to appeal. Most IRS appeals never get the attention they deserve because the taxpayer tries to handle them personally and the Office of Appeals officer compares the file against a professionally prepared one. We prepare the case, file the appeal under the right form, and argue it in writing or in conference.
The essentials, at a glance
- What can be appealed
- Audit results, rejected Offers in Compromise, liens, levies and penalty determinations.
- The deadline that matters
- 30 days from a Final Notice to request a Collection Due Process hearing on Form 12153.
- Who hears it
- The Independent Office of Appeals, which is separate from the examiner or officer who made the decision.
- The guide
- Publication 5 sets out appeal rights and what a written protest has to contain.

How this case usually unfolds
Disagreed with the IRS · IRS appeals
Appeal cases usually come to us after an audit closed badly or an Offer in Compromise was rejected. The pattern is to review the file against what the Office of Appeals will expect, file the appeal under the right form and deadline, and argue it in writing or in conference rather than letting the original determination stand.

Get Free ConsultationWhat a tax appeal can challenge
Audits are the most common appeal trigger, but they are not the only one.
Audit determinations
If the audit closed against you and you have grounds to disagree, you can request appeal review before paying.
Collection actions (liens, levies, seizures)
You have the right to a Collection Due Process hearing when the IRS files a lien or issues a notice of levy.
Rejected Offer in Compromise
An OIC denial is not the end. We review the rejection reason and either appeal or restructure the offer.
Penalties and interest
Penalties added during audit or for late filing can be appealed when you have reasonable cause.
Installment, innocent spouse, and penalty abatement denials
Most denied applications can be appealed within the IRS Office of Appeals.
When a tax appeal is not the right move
Sometimes the better path is a fresh resolution proposal rather than a formal appeal. If the IRS sent you a bill with no mention of appeal rights, if your concern is purely affordability, or if you have new documentation that was not in the original record, we may recommend a different route.
Federal programs
Nine IRS programs. We look through them all.
Most tax debt is resolved through one of these nine programs. Which one fits depends on your numbers, your filing history, and assessment dates.

How to Negotiate With the IRS

Unpaid IRS Taxes: Delinquent Tax Help
Delinquent taxes are any federal or state tax owed but not paid by the filing deadline. Unpaid taxes do not get smaller by waiting: penalties and interest compound, and the IRS escalates from notice to lien to levy on a predictable timeline. The good news is every step of that path is reversible if you act before a levy hits.
